Keep in mind, the California Birthday rule does not apply to the new Innovative plans because moving to an Innovative plan is considered an upgrade, so you must be either new to medicare (6 month open-enrollment), exiting a group health policy (2 month open-enrollment) or moving out of your current medicare advantage service area (2 month).
The California Birthday rule allows you to move to a different company with the same plan or one with less benefits. If you wish to upgrade, you must answer the health questions on the new company application.
